TERMS & CONDITIONS  

 

1. Initiative Description

Human Race PW, LLC con sede in 10960 Wilshire Blvd., 5th Floor
Los Angeles, CA 90024 (“Human Race”) is conducting an online survey (hereinafter, the “Survey”) for the purposes of collecting feedback and insights. As a token of appreciation, each participant who registers and completes the Survey will receive a gift, as described below.

2. Eligibility

Participation is open to individuals aged 18 or over. Employees, collaborators, or agents of Human Race, as well as their immediate family members, are not eligible to participate.

3. How to Participate

To participate in the initiative, individuals must:

a. Register through the dedicated online form;

b. Complete the Survey in full;

c. Provide a valid email address.

4. Gift and Delivery

Upon successful completion of the Survey, participants will receive an email from Human Race containing instructions to collect a complimentary gift. The gift offered is not awarded based on chance, merit, or the content of responses, but is provided equally to all eligible participants who complete the Survey,

The gift is intended as a gesture of appreciation and is available to all participants who complete the Survey.

The gift cannot be object of resale, nor can they be exchanged and/or refunded and/or be redeemed for cash or substituted.

5.Duration

The Survey will remain open until Human Race has collected a sufficient number of responses to meet the objectives of the initiative. This number has been predefined internally and is not influenced by the content of individual responses.

6. Limitation of Liability

Human Race shall not be liable for any technical issues, system failures, or interruptions that may affect participation in the Survey, where such issues arise due to events of force majeure.

For the purposes of these Terms and Conditions, force majeure refers to events beyond the reasonable control of Human Race, including but not limited to natural disasters, acts of government or regulatory authorities, war, civil unrest, strikes, power outages, pandemics, or failures of internet service providers or hosting infrastructure not attributable to Human Race

7. Data Protection

The personal data provided by participants will be processed in compliance with applicable data protection laws, including Regulation (EU) 2016/679 (GDPR), and  Human Race Privacy Policy for this initiative.[GPBL1] 

8. Acceptance of Terms

By participating in the Survey, participants fully and unconditionally accept these Terms and Conditions.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy. Any dispute arising out of or in connection with the initiative shall be subject to the exclusive jurisdiction of the courts of Milan.

 

PRIVACY POLICY

 

1.     Identity and contact details of the Data Controller

Los Angeles, CA 90024 (“Human Race” o “We”, “our(s)”) as the data controller. Human Race can be contacted at the following email address:  help@humanrace.com

2.     Purpose and legal basis for processing

Human Race will process your data for the following purposes:

a)     if you have filled in the relevant online form, to allow you to participate in the survey and enabling you to collect the complementary gift, based on the necessity to the performance of a contract to which the data subject is a party or the performance of pre-contractual measures taken at the request of the data subject (Art. 6 para. 1 letter B) GDPR). The provision of your data (in particular first name, last name and e-mail) for this purpose is necessary in order to be able to collect the gift;

a)     to carry out statistical and aggregate data analysis activities of those who have participated in our initiatives, based on the legitimate interest of Human Race to improve its products and services (Art. 6 para. 1 letter F) GDPR). Providing data for this purpose is not necessary and you can object to this processing in the manner described below. Human Race has balanced its legitimate interest against your rights and freedoms and concluded that the latter do not prevail;

b)     to send you commercial communications, newsletters and updates regarding Human Race products similar to the gift received by registering and participating to the survey, only via email , except if you refused to receive such communications and without prejudice of the possibility to opt-out at any moment, on the basis of art. 130 paragraph 4 of Legislative Decree 196 of 2003

c)     if you visited one of our physical points (i.e. Spazio Maiocchi, Terroir or others, as the case may be) and agreed to participate in audio/video/photographic filming, to record videos and pictures that will be shared by Human Race through different channels, including social networks, based on your consent, freely given and revocable at any time (Art. 6 para.1 lett A) GDPR) and upon authorization to create promotional materials. Any withdrawal of consent will not affect the lawfulness of the processing activities carried out prior to the same.  Refusing to provide consent may limit your ability to participate in events held at our physical locations, as it would prevent Human Race from giving external visibility to these initiatives.

 

3.     Data recipients

Your personal information may be disclosed to individuals acting on behalf of Human Race who have been duly instructed to process it (e.g., administrative, commercial, marketing, or system administrators) and to external parties (such as technical service providers, hosting providers, companies providing ICT services, communications agencies) who will be appointed as data processors, if necessary.

If such parties are located in a country outside the European Economic Area that does not provide an adequate level of protection, Human Race takes appropriate safeguards to ensure the protection of your personal data. This includes, for example, signing standard contractual clauses approved by the Commission. You can ask for more information at the contact details identified above.

4.     Data retention time

Your personal data will be processed for as long as necessary for the purposes for which it is collected. Thereafter, your personal data may be deleted or anonymized, unless retention is required by law.

The retention period are specifically:

a)     until the end of Settimana del Salone del Mobile for the purpose of (a);

b)     18 months after collection for statistical and aggregate analysis purposes, unless data are anonymized;

c)     24 months after collection for marketing purposes and for sending newsletters, communications and updates;

d)     5 years from collection for creation of promotional materials.

Human Race may retain data for longer periods if required by legal obligation or in the case of claims and legal actions.

5.     Your Rights

As a data subject, you can exercise the following rights with regard to your personal data:

a)     Right to withdraw consent at any time;

b)     Right to obtain information about the data processed by Human Race, certain aspects of processing, and to receive copies of personal data processed;

c)     Right to object to the processing of personal data based on legitimate interest, based on reasons related to your particular situation, or in case of direct marketing;

d)     Right to verify and request rectification of your personal information;

e)     Right to restriction of processing, when one of the following applies: (i) for the period necessary for Human Race to verify the accuracy of the personal data whose accuracy you have contested; (ii) in case of unlawful processing of your personal data; (iii) if it is necessary for the establishment, exercise or defense of a legal claim; (iv) for the period necessary for the verification as to whether Human Race's legitimate grounds prevail over your request to object to the processing.

f)      Right to receive certain personal data related in a structured, commonly used and readable format as well as the right to transmit such data to another data controller without hindrance.

g)     Right to obtain the deletion of personal data concerning you if any of the following reasons exist: (i) personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed; (ii) data are being processed unlawfully; (iii) you have withdrawn consent and there is no other legal basis allowing the processing activity; (iv) you have objected to the processing activity and there is no overriding legitimate ground; (v) personal data must be deleted to fulfill a legal obligation.

You also have the right to lodge a claim to the relevant data protection authority if you believe that Your personal data has been unlawfully processed.
